Subject: Important Updates and Information for Local 1250 Members Dear Local 1250 Members,
We are writing to provide you with important updates and information about our local, ensuring you have all the facts necessary to make informed decisions about your membership and participation.
Growth and Achievements
Since Local 1250 (Arizona) was established in 2013 under the leadership of Local President Juan Casarez, we have seen significant growth. From starting with 113 members, we grew to over 600 by 2018. In 2018, District 12 National Vice President George McCubbin approached us to take responsibility for Nevada, where Local 1240
was struggling. Under our leadership, Nevada’s membership has grown from 384 in 2018 to 746 as of today, June 27, 2024. We now have a combined membership of 1536 members between Arizona and Nevada.
2024 Collective Bargaining Agreement
The new 2024 Collective Bargaining Agreement (CBA) brings significant changes for all Bargaining Unit Employees (BUEs). Notably, union members now enjoy additional rights compared to non-members.
Key Rights for Union Members:
Weingarten Rights: Union members can invoke their Weingarten Rights to have a union representative present during any fact-finding session, questioning, interview, or examination. This ensures that members have support and representation when interacting with management.
Grievance and Arbitration: If a union member faces unfair disciplinary actions, the union can represent them through the grievance process and take their case to arbitration. Arbitration can be a powerful tool to ensure fair treatment and justice. The costs for arbitration vary: standard arbitration ranges from $2000 to $10000, and expedited arbitration costs around $4500.
For Non-Members:
Lack of Representation: Non-members will not have the right to invoke Weingarten Rights. This means that during any fact-finding session or questioning by management, non-members will not be allowed to have anyone else present on their behalf. This includes attorneys, other witnesses, or any form of representation. Non-members will face these situations entirely alone, without any support or advocacy.
No Access to Arbitration: Non-members do not have the ability to take their grievance cases to arbitration. Only the union can invoke arbitration, which means that non- members must handle any disputes or disciplinary actions without the option of having their case reviewed by an arbitrator. This significantly limits their ability to challenge unfair treatment effectively.
Recent Changes and Member Concerns
We strive to provide fair and diligent representation for all our members. Recently, Local President Juan Casarez made the decision to remove Steward Vanessa Pearson from her position as a designated union representative on 100% official time. Similarly, Nevada
Vice President Becky Cooper’s duties and 100% official time as a union representative have been removed. Becky Cooper remains the Vice President for Nevada and retains full voting rights on the Executive Board.
We understand that these changes have led to inquiries and some members considering withdrawing their membership. We assure you that these decisions were made with the best interests of the local in mind. We encourage all members to seek clarity, ask questions, and participate in our meetings. Your engagement is crucial for our collective success.
